John Trice

A VERY special thanks must go to Virginia Ewing who put a copy of this will in her Day book which she shared with me.

In the name of God, Amen, I JOHN TRICE of County of Jones in the state of Georgia being weak in body, but of sound and perfect memory, blessed by god for the same: do publish and make this my last will and Testament in the manner following that is to say, first I give and bequeath to my son JAMES TRICE all the Lot of Land where on he now lives containing two hundred two and a half acres lying in the 9th district of Baldwin County, which is now Jones county,No. One hundred and fifth-eighth, that said lot of land shall be all he the said JAMES TRICE shall ever hae of my estate should amount to more than thirty one hundred except then he the said JAMES TRICE shall have an equal part of the balance. And I do further will that remainder of my estate which may remain after paying all just debts and the Legacy and bequest mentioned, shall be sold giving twelve months credit as soon after my decease as is convenient, andthe next proceeds divided equally between my wife MARY TRICE, my oldest son, BENJAMIN TRICE, my second son ELISHA and my son-in-law JONATHAN DAY and my three daughters following, that is to say, PATTY CATES, and TABITHA HASKINS and FRANCES MORAN. It is moreover my will that my wife, MARY TRICEE may hold possession of the whole of my estate aforesaid until the day of sale which shall be appointed by my executor, and I do here by appoint my son JAMES TRICE of the county and State aforesaid and JOHON SPEIR to be Executors of this my last Will and testament hereby reoking all former wils by me made. In Witness whereof I have here unto set my had and seal the twenty-ninth day of December in the year of our Lord one thousand eight hundred and ten.

Signed, Sealed, published and declared by the above named JOHN TRICE to be this last Will and Testament in the presence of us who have hereunto subscribed our names in the presence of the Testator.

I personally appeared Benjamin Finney who being duly sworn depose and saith that the foregoing instrument of writing contains the last Will and Testament of Jhon Trice late of this County deceased, and that it never underwent any alteration since it was executed and that Henry Finney and Stephen Grafford did subscribe their names with this deponent as Witnesses thereto. sworn to before in Court this sixth day of July 1812.
